That's what impeachment is for

A bipartisan group of House members announced on Wednesday that it is filing a lawsuit charging that President Obama made an illegal end-run around Congress when he approved U.S military action against Libya.

“With regard to the war in Libya, we believe that the law was violated. We have asked the courts to move to protect the American people from the results of these illegal policies,” said Rep. Dennis Kucinich (D-Ohio), who led the 10-member anti-war coalition with Rep. Walter Jones (R-N.C.).
So a judge is supposed to tell the commander in chief that he must pull troops out of Libya or something? Good God, that's even a worse solution than what we have now*.

Instead I have a little suggestion: if you truly believe that Obama had violated the law, if you believe that he has abused his authority as commander in chief, then you get a new one. Impeach Obama, remove him from office, and make Jumping Joe Biden the new commander in chief.  Not only is that course of action within your power, it's how the freaking Constitution was designed to work in the first place. In other words, that's your job.

But if you don't have the votes** to impeach the President, then I respectfully request that the undistinguished member from Ohio*** sit down, shut up, and yield the balance of our time to Anthony Weiner.

* Besides, the most likely result will be the Supremes throwing out the War Powers act, leaving little or no room for Congress to complain about similar acts in the future. Left or right aside, presidential appointees like the Supremes are consistently deferential to presidential power.
** or more likely, the balls

Actually I find it delicious irony that the poster child of the american left gets told by a single judge that his own authority is greater than teh President's. You will no doubt remember that the American left is famous for getting judges to give them what they were emphatically denied in the ballot box, in the legislature and in plebicites.

Gay marriage? We don't care about your laws and referenda or supermajorities. One judge in California can tell you what to do.

Not enough school funding? Judges to the rescue. You will raise enough taxes to pay teachers in disadvantaged areas.

Gays in the military? Fold, judges are going to make us do it anyway.

Abortion? Some states like it, some states don't. but a narrow majority of one judge naw makes it the irevokable law of the land.

There was never any chance that the first black president was going to be impeached. It would be Henry Flipper all over again.

I'd be perfectly willing to remove Obama and then revisit the issue in 50 years or so. Flipper is great precedent for that sort of thing.

That said, I blame the congress wholly for executive overreach anyway. If you give a guy a big army and $700b a year to spend, he's going to find places to use it. Cut the armed forces by 60% or so, and that ceases to be a problem. Or at least as big a problem.

The comments on Yahoo! last night were overwhelmingly "impeach" and "withdraw from NATO."

When you don't know what the Constitution says (and most of Congress doesn't), the whole idea of impeachment is a whole new concept.

Now, suing for your own way, that's different. That's the American way of life.
